Please read these Terms and Conditions ("Terms") carefully prior to utilizing or placing orders through vivaahessential.com (the "Platform"), operated by VIVAAH – The Wedding Essentials("VIVAAH", "Atelier", "we", "us", or "our"), having its principal atelier situated beside Vasu Event Services, Bhugaon, Bavdhan, Pune, Maharashtra 412115. By accessing our platform, commissioning bespoke artifacts, or consummating a transaction, you acknowledge your unconditional agreement to be bound by these statutory provisions in full compliance with the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020.
1. Regulatory Compliance & Contractual Eligibility
This electronic agreement is promulgated pursuant to the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and does not require physical or digital signatures.
By accessing or procuring goods from the Platform, you affirm and warrant that you are a competent individual at least 18 years of age possessing full legal authority to enter into a legally enforceable contract under the Indian Contract Act, 1872.
2. Nature of Handcrafted Goods & Natural Variations
VIVAAH specializes in high-end, hand-finished ceremonial wedding essentials, encompassing Banarasi zari brocade, pure brass repoussé, micro-velvet upholstery, gota patti lacework, hand-carved teakwood, and kundan-embellished artifacts.
You expressly recognize that handcrafted artisanal creations inherently exhibit subtle variations in weave texture, dye hue depth, metal patina, and hand-embroidery alignment. Such distinctive nuances are inherent hallmarks of authentic Indian craftsmanship and shall not be classified as manufacturing defects, substandard workmanship, or non-conformity under any circumstances.
3. Pricing, Commercial Invoices & Statutory Taxes
All commercial quotations and displayed prices on the Platform are denominated in Indian National Rupees (INR / ₹) and are inclusive of applicable Central Goods and Services Tax (CGST) and State Goods and Services Tax (SGST) or Integrated Goods and Services Tax (IGST) in accordance with the Central Goods and Services Tax Act, 2017.
VIVAAH reserves the absolute prerogative to recalibrate catalog pricing, promotional concessions, and delivery surcharges at its sole discretion without antecedent notice, provided that transactions confirmed via order receipt shall remain honored at the confirmed pricing.
4. Payment Gateways, Verification & Transaction Security
All electronic card transactions, Unified Payments Interface (UPI) transfers, and net banking remittances are routed through RBI-licensed, PCI-DSS Level 1 compliant payment aggregators (including Razorpay Software Private Limited).
VIVAAH does not harvest, warehouse, or process your sensitive cardholder data or banking PINs. We shall not be held liable for fraudulent debits resulting from unauthorized access to your banking apparatus, third-party breaches, or network interruptions during transaction processing.
5. Order Confirmation, Logistics & Courier Transit
Consignments are fulfilled across India via certified logistics providers (including Shiprocket, Blue Dart Express, and Delhivery). Dispatch timelines range from 24–48 hours for ready-to-ship catalog suites, and 7–14 business days for bespoke bridal commissions.
Delivery dates furnished at the point of checkout represent reasonable commercial estimates. VIVAAH shall not be liable for delivery deferrals precipitated by force majeure events, severe meteorological conditions, civil disturbances, or state regulatory blockades.
6. Cancellation Protocol
Customers may cancel standard catalog orders within 12 hours of order placement by notifying the concierge at hello@vivaahessential.com, provided the shipment has not transitioned to the "PACKED" or "DISPATCHED" status.
Customized, personalized, or monogrammed trousseau boxes, safas, and ceremony platters cannot be cancelled or altered once fabrication or engraving has commenced.
7. Intellectual Property & Brand Ownership
All visual trademarks, proprietary trade dress, atelier emblems, product photography, editorial copy, styling arrangements, and software source code displayed on the Platform remain the sole and exclusive intellectual property of VIVAAH.
Any unauthorized reproduction, commercial scraping, unauthorized framing, or publication of VIVAAH imagery or trademarks without prior written consent constitutes an infringement of the Copyright Act, 1957, and the Trade Marks Act, 1999, subjecting the violator to immediate civil and criminal prosecution.
8. Limitation of Liability
To the fullest extent permissible under Indian jurisprudence, VIVAAH, its proprietors, artisans, and logistics partners shall not be held liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use our products or services.
Our aggregate commercial liability in connection with any claim arising out of a purchased product shall not exceed the actual invoice sum paid by the customer for that specific item.
9. Governing Law & Dispute Resolution
These Terms and any contractual agreements for the purchase of goods shall be governed by and construed in strict adherence to the substantive laws of the Republic of India.
Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent civil courts situated in Pune, Maharashtra, India.
